Terms of the contract of carriage

 


Prohibited goods are strictly prohibited from being transported, and violators will be sent to relevant units. Relevant accounts will also be terminated in a timely manner. The shipper and our company, as carriers, must acknowledge the following terms and conditions as a mutually binding and legally binding agreement. The shipper shall accept and comply with the terms of this contract from the date of payment of the freight.


1Responsibilities and commitments of the shipper and carrier:

 

1. The shipper and its authorized agent guarantee that the entrusted goods for shipment comply with national laws and are acceptable to the transportation department, and do not violate the will of the carrier. Our company, the carrier, refuses to carry the following items:

1) Flammable, explosive, perishable, or toxic, explosive, lethal, corrosive, and radioactive hazardous materials

2) Drugs or drug related equipment

3) Articles that infringe upon trademarks, copyrights, or property rights

4) Currency, value-added tax invoices, other tax receipts or securities, gold and silver treasures, antiques, precious metals

5) Living animals, plants, or seeds

6) Correspondence Letters

7) Prohibited items subject to customs import control.

8) Goods that do not comply with relevant government administrative regulations, departmental rules, and mandatory standards of the carrier and destination

9) Items that require refrigeration

2. The shipper promises that our company has the right to waive or refuse to accept items that are not suitable for express transportation, intentionally or unintentionally conceal the true name and value of the items, as well as items that are prohibited by national laws from being carried, mailed, or transported. Once violated, the shipper is willing to bear all legal and economic compensation responsibilities arising from this.

 

3. The shipper and its authorized agent guarantee to accept and pay the freight rates of the goods announced by our company, as well as the related storage, return, and transportation fees.

 

4. If any liquid or solid overflows, seeps, or leaks from the shipper's goods, or causes pollution or damage to other goods due to improper packaging or the goods themselves, our company has the right to hold the shipper responsible for all legal and economic compensation.

 

5. The TITAN Freight Australia Special Line only accepts and processes one waybill number and one package (which can include multiple items from the store). If the seller provides a waybill number but sends out two or more packaged goods, the TITAN Express Australia warehouse will reject the relevant goods or sign for them. If there are any losses, our company will not be liable for compensation.  

 

6. Once the goods are received and signed for by the TITAN Freight Australia Special Line, if they need to be returned or forwarded to other places in China, the shipping cost will be calculated separately. The shipping cost will be based on the customer service quotation on the day of shipment.  

 

7. If any loss, omission, or change in transportation costs occur due to the following circumstances, TITAN Transport Australia Limited will not be responsible:
Scenario 1: The seller issues a waybill number, but the package contains goods from two or more customers, resulting in some customers not being able to claim other goods.

 

***The customer needs to contact the seller to ensure that the waybill number at the time of shipment is only for the customer's goods***

 

Scenario 2: (Customer purchases two or more goods) The seller only provides the customer with one waybill number, but in reality, the seller separates the customer's goods into two or more waybill numbers, resulting in the customer not being able to claim other goods.  

 

***The customer is responsible for contacting the seller and obtaining other correct waybill numbers for claim***  

 

Scenario 3: If the seller provides an incorrect waybill number, which results in the correct waybill number exceeding the 60 day free storage period. A storage fee is required.  

 

***The customer is responsible for contacting the seller, obtaining the correct waybill number for claim and negotiating with the seller regarding storage fees***  

 

8. Customers must log in to the TITAN Freight Australia Special Line to claim and choose a combined express service (contact the customer service personnel of the TITAN Freight Australia Special Line to apply for order transportation) within 60 days from the day the goods are sent to the TITAN Freight Australia warehouse. Otherwise, starting from the 61st day, a storage fee of ¥ 5 (RMB) will be charged for each item per day.  

 

9. The goods must be shipped out within 90 days of arrival at the TITAN consolidation warehouse in Australia, otherwise they will be treated as scrap and handled by our company. The owner shall not have any objections.  

 

10. If it is less than 1 kilogram (KG), it will be calculated as 1 kilogram (KG).  

 

***Example 1: The total weight of all goods is 0.99 kilograms (KG), which will be calculated as 1 kilogram (KG) on the order***  

 

***Example 2: The total weight of all goods is 1.01 kilograms (KG), which will be calculated as 2 kilograms (KG) on the order***  

 

11. The unit of weight calculation is kilograms (KG), with an accuracy of one decimal place, that is, 0.1 kilograms is the lowest scale.  

 

12. The delivery time for the TITAN freight Australia special line is from 9:00am to 6:00pm from Monday to Saturday. Please refer to the latest announcement for the settlement time.

 

13. Due to the fact that foreign delivery and transportation companies are off on Sundays or public holidays, TITAN consolidated transportation in Australia will suspend shipments during public holidays. Any changes made will be subject to our company's announcement.

 

14. Logistics companies will not deliver goods on Sundays or public holidays.

 

15. All weight and dimensions of the goods shall be based on the actual warehousing data. The billing weight is calculated based on the difference between the volumetric weight and the actual weight. The volumetric weight is equal to length * width * height/6000, measured in cm. If the weight is less than 1KG, it will be calculated as 1KG.

 

***Volume weight is a calculation method that reflects the density of a package, and hypervolume indicates that the volume weight is greater than the actual weight***

2The right to know of the transported item:

 

1. Our company has the right to know the nature, name, quantity, and weight of the transported goods, in order to assist relevant government departments and transportation departments in inspecting or investigating the transported goods.

 

2. Items commissioned for shipment by TITAN's Australian dedicated line will be randomly sampled for investigation. If it is found that the item does not meet the requirements of the "carrier contract terms", our company will refuse to carry it.

 

 

3Retention rights of the transported items:

 

 

1. If the shipper and its authorized agent fail to pay the payable freight and related fees in accordance with the provisions of the carrier contract, the carrier has the right to retain the transported goods and reserves the right to claim compensation from the shipper and its authorized agent, and is not liable for any losses incurred as a result.

 

2. The goods must be shipped out within 90 days of arrival at the TITAN Australian freight line for collection, otherwise they will be treated as scrap and handled by our company. The owner shall not object.

 

4Disclaimer:

 

1. Our company is not responsible for any delay, loss, destruction or confiscation of goods caused by force majeure, such as customs inspection, war, riots, adverse weather, flight delays, crashes, typhoons, fires, floods, major traffic accidents, serious natural or man-made disasters, and various situations beyond our control or confiscation caused by the shipper.

 

2. Our company shall not be liable for any indirect losses or other non subjective losses caused by the delay or loss of goods transportation.

 

3. Our company is not responsible for any delays, errors, or losses in the delivery of goods caused by the following reasons:

 

1) Due to the shipper's reasons, such as incorrect or incomplete address provision, incorrect phone number, etc; The recipient's address has changed or the region where delivery cannot be made.

 

2) Due to the fact that the goods entrusted by the shipper themselves violate the relevant national policies and laws, such as flammable, explosive, easily polluting, corrosive, and toxic powders, water agents, and other dangerous goods.

 

3) Various losses caused by the shipper's failure to declare and improper packaging.

 

4. Due to the fact that our company's logistics services are based on the packaging upon receipt of goods, combined and shipped out, if the goods themselves are not properly packaged, do not meet the requirements for safe transportation of goods, or if special substances (such as important items, easily damaged items, etc.) are marked to our company, the shipper shall be responsible for the damage and any resulting responsibilities.

 

5. In order to protect the rights and interests of customers, except for conducting inspections on the carrier items at the request of government departments and transportation departments or conducting regular random sampling surveys by our company, our domestic logistics transfer stations will not open the packaging of goods for members to conduct quantity or quality inspections when signing for goods from customers. Our company shall not be liable for any losses caused by the quantity, nature, or characteristics of the items.

 

5Missing item handling:

 


1. If any items are lost, please email to ph@titan-buy.com Upon verification, if it is found that the shipment was lost due to logistics transportation issues, the maximum compensation amount shall be three times the shipping cost.  

 

2. The scope of protection only includes the TITAN freight Australia dedicated line to the designated address of the destination.

 

3. Excluding domestic delivery to TITAN's Australian dedicated line for container collection.

 

4. If not, please go to:

 

After reviewing the email application, our company will decide whether to make compensation, with a maximum compensation limit of three times the shipping cost and not exceeding the actual value of the goods.

 

 

 

5. Any claim must be submitted by email to our customer service email address within 24 hours of receipt ph@titan-buy.com Declaration.

6. If the declaration is delayed, our company will consider that the transportation has been completed according to regulations and will no longer accept it.

 

7. After arriving at the port and finding the lost item, our company will arrange for a reshipment. The found item is not within the scope of compensation and will not be compensated.  

 

8. In case of any dispute, our company reserves the final decision right.  

 

  

6Damage handling

 

 

1. The customer is obligated to have good communication with the seller to ensure that the transported items have sufficient durable support, strong toughness, and thick inner and outer packaging or containers to prevent damage or loss of the goods due to improper packaging during transportation; The packaging should have sufficient and suitable protective materials in the box or outer packaging, which should be integrated with the protective materials, cushioning materials, and contents of the goods; If there are multiple contents, there should be no sound generated between the contents and the inner wall of the outer packaging due to friction, collision, squeezing or shaking. Our company will not make any compensation for any damage caused by packaging discrepancies or fragile items during transportation.   

 

 

7Logistics Claim Details

 

 

After determining the establishment of a claim case, it usually takes about 10 working days to complete the compensation.

 

2. All compensation amounts shall be settled in RMB.

 

3. All compensation amounts will be transferred to the TITAN freight Australia dedicated account, and refunds to other accounts will not be accepted.


8Freight Payment

 

1. Order freight payment supports WeChat, Alipay, paypal, Alibaba, BDO bank card payment

 

2. If there is any dispute, the TITAN Freight Australia Special Line will reserve the final decision right.  

 

 

 

9Regarding the customer's shipping address

 

 


1. Logistics companies will not deliver goods on weekends or public holidays.

 

2. To protect customers, the logistics company will only deliver goods according to the address on the order.  

 

3. Address cannot be changed after order confirmation

 

4. If the customer provides other work or residential addresses that are not the recipient, our company will not be responsible for any problems during the delivery of the goods.
